Foodaya Terms of Use
These Terms of Use (the “Terms”) govern your use of the Foodaya app and website. Foodaya is a product of Jar XL Innovations LLC (“Jar XL Innovations”, “we”, “us”). By creating an account or using Foodaya, you agree to these Terms. If you don't agree, please don't use the app.
Who can use Foodaya
You must be at least 13 years old to use Foodaya. You're responsible for keeping your account secure and for all activity that happens under it.
Subscriptions and billing
- Foodaya Premium is an auto-renewing subscription that gives expanded use of the app's AI features, subject to monthly and daily fair-use limits, (receipt scanning, AI recipe ideas, smart shopping lists, and insights). Every account gets 10 free AI actions to try those features first; once they are used up, the AI features require Premium. The free actions are one-time and do not renew.
- The price and billing period are shown in the app before you purchase. The subscription renews automatically for the same period unless you cancel at least 24 hours before the end of the current period.
- On the web, Foodaya Premium is purchased at foodaya.app and billing is handled by Stripe. You can manage or cancel your subscription anytime from the Account page in the app or on the web.
- In the iOS app, Foodaya Premium is purchased, managed, and billed through the App Store under your Apple Account. Cancel anytime in iOS Settings → your name → Subscriptions — not from the Stripe portal. Refunds for an App Store purchase are handled by Apple under Apple's own refund policies, not by Foodaya.
- Except where required by law, payments are non-refundable.
User content and community rules
Foodaya lets you post recipes and interact with other cooks through a public feed, comments and replies, follows, and direct messages sent when you forward a post to someone. You own the content you create, but you grant Foodaya a license to host and display it so the app can function.
You agree not to post or send content that is unlawful, harassing, hateful, abusive, obscene, threatening, infringing, spam, or otherwise objectionable. This applies to private messages exactly as it applies to public posts. There is no tolerance for objectionable content or abusive users.
We provide tools to report objectionable content — a post, a comment, a conversation, or a user — and to block other users. Blocking stops that person messaging you, sending you recipes, or seeing your posts. We review reports and may remove content, and suspend or terminate accounts, that violate these Terms — typically within 24 hours of a report. Posts, comments and messages are also screened automatically before they are stored, and content that fails that check is rejected.
Communities
Any user can create a community and becomes its moderator. A moderator chooses whether the community is public (anyone signed in can read it) or private (only members can), approves requests to join a private community, sets its name, description and banner, and can remove posts from it. Moderators run their communities within these Terms: every rule above applies inside a community, to moderators as much as to members, and reports about community content come to us, not only to the moderator. We may remove any community, or remove a moderator, that breaks these Terms. When a moderator deletes their community or their account, the community and every post in it are deleted.
Health and nutrition disclaimer
Foodaya's recipes, nutrition estimates, expiration dates, and AI suggestions are for general informational purposes only and may be inaccurate. They are not medical, dietary, or food-safety advice. Always use your own judgment about what is safe to eat, and consult a professional for medical or dietary needs.
Acceptable use
Don't misuse the service — for example by attempting to break security, scrape data, disrupt the service, or use it to violate the law or others' rights.
Copyright and DMCA
Only post content you own or have permission to share. If you believe content on Foodaya infringes your copyright, send a notice to our designated agent as described in our Copyright & DMCA Policy. We remove or disable access to material identified in valid notices, honor valid counter-notices, and terminate, in appropriate circumstances, the accounts of repeat infringers — including any account that has had content removed in response to three valid notices.
You may submit a public recipe link to create a private, editable recipe draft for your own Cook Book. Foodaya keeps the source link and creator credit. Imported recipes are not published directly: sharing one to Discover creates a separately reworded copy, and you remain responsible for having the right to share any content you publish.
Affiliate links
Foodaya participates in the Amazon Associates Program. As an Amazon Associate, Foodaya earns from qualifying purchases. Using these links costs you nothing extra.
Termination
You can stop using Foodaya and delete your account at any time from within the app. We may suspend or terminate accounts that violate these Terms.
Disclaimers and limitation of liability
Foodaya is provided “as is” without warranties of any kind. To the maximum extent permitted by law, we are not liable for any indirect, incidental, or consequential damages arising from your use of the app.
Governing law
These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws rules. Any dispute arising out of or relating to these Terms or your use of Foodaya will be brought exclusively in the state or federal courts located in Palm Beach County, Florida, and you and we each consent to the personal jurisdiction of those courts.
Changes to these Terms
We may update these Terms from time to time. Material changes will be reflected by updating the effective date above.
